DUI With a Child in the Car: How It Changes the Charges

Gutin & Wolverton: Harley I. Gutin March 16, 2026

Getting behind the wheel after drinking or using impairing substances is always a serious mistake, but when a child is in the car, the situation could become far more heartbreaking. You might have thought you were okay to drive, or that a short trip wouldn't hurt anyone.

The reality hits hard. A child's safety was put at risk, and the legal consequences now escalate dramatically.

Parents, guardians, or anyone responsible for a minor often feel overwhelming guilt, fear for their future, and worry about the family's impact. These emotions are completely understandable. Many people in this position never intended harm, but they now face life-altering repercussions.

At Gutin & Wolverton, we've guided numerous clients through these tough circumstances, helping them address the charges and work toward the best possible outcome. A standard DUI charge becomes significantly more severe when a passenger under 18 is present, per Florida law.

We serve clients in Brevard County, Florida, and the surrounding areas of Cocoa, Titusville, Melbourne, and Palm Bay, as well as all beachside communities, including Cocoa Beach and Merritt Island Beach. Reach out to our firm today to schedule a consultation.

Florida Law on DUI With a Child Passenger

Florida Statute § 316.193 defines driving under the influence as operating a vehicle with a blood or breath alcohol level of 0.08 or higher, or while impaired to the extent that normal faculties are affected.

When a person under 18 accompanies the driver, subsection (4) triggers automatic enhancements. This applies regardless of the child's relationship to you, your own child, a relative, or even someone else's minor.

The law treats this as an aggravating factor because it endangers a vulnerable passenger. No actual injury to the child is required for the enhancement to apply. Prosecutors pursue these cases aggressively to protect minors.

This change turns what might be a misdemeanor DUI charge into a charge with harsher mandatory consequences, making early legal intervention critical.

How Penalties Increase With a Child in the Vehicle

The presence of a minor doubles down on standard penalties in several ways. Courts must impose minimums that are stricter than for a regular DUI charge.

Key differences include:

  • Higher fines: For a first DUI charge, fines range from $1,000 to $2,000 (compared to $500–$1,000 without a minor). A second conviction jumps to $2,000–$4,000.

  • Longer potential jail time: A first offense carries up to 9 months in jail (versus the standard six months). A second can reach 12 months.

  • Mandatory ignition interlock device: Installation for at least 6 months is required, often longer for repeat offenses.

  • Extended license suspension and other requirements: Probation, community service (often 50 hours or more), and DUI school become more stringent.

These enhancements apply even for a first-time offender. Additional factors, such as a high BAC (0.15+), can compound the severity. These increased penalties reflect the state's priority on child safety and make a conviction far more impactful on your record and your daily life.

Additional Charges and Long-Term Consequences

Beyond the enhanced DUI charge, other serious issues can arise. Prosecutors may file separate counts, especially if circumstances suggest neglect or endangerment.

Common additional risks include:

  • Child endangerment or neglect charges: Under Florida Statute § 827.03, impaired driving with a child can lead to felony accusations, particularly if an accident occurs or the child's welfare appears compromised.

  • Child Protective Services involvement: Authorities may investigate family dynamics, potentially leading to temporary custody changes or required parenting evaluations.

  • Collateral effects: A felony-level escalation creates a permanent criminal record, dramatically affecting employment, housing, professional licenses, and insurance rates.

Even without separate charges, the enhanced DUI charge alone carries lifelong repercussions like restricted driving privileges and higher costs. An experienced DUI lawyer can help identify defenses and mitigate these overlapping issues before they escalate further.

Defenses and Strategies for These Cases

Challenging a DUI charge with a child passenger follows similar principles to standard cases but requires careful handling due to the heightened stakes. Possible approaches include questioning the legality of the traffic stop, the accuracy of field sobriety or chemical tests, or whether impairment truly existed.

The child's presence doesn't change the core elements prosecutors must prove, but it influences how judges and juries view the case. Strong evidence, like video footage, witness accounts, or medical records showing no impairment, can sometimes lead to reduced charges or dismissal.

Plea negotiations often focus on avoiding felony additions or minimizing jail exposure. Working with counsel early allows you to build a defense tailored to the facts and potentially resolve the matter with less severe outcomes.

A DUI charge involving a child passenger demands serious attention because the enhancements and potential added accusations change everything. While the situation feels overwhelming right now, know that many people have come through this difficult period with their rights protected and their futures intact.
